59 / Male Charlotte NC USA My name is Phillip Anthony Harwood. I was born 3-5-51 have brown hair and hazel eyes. 6 foot, approximately 210 lbs. I was born in Charlotte NC and raised in Albemarle. This bio will be to an extent a plea for help and a great need for friends to believe in me and to what I have to state as facts. This bio is not as much about my personal life, that of which I will write to anyone who cares enough to write me, but it's at this point and time about my situation and how I came to be in prison. I will not lie and the records and transcripts will attest that what I write is the truth. Since 1998, I have been fighting, through the courts to prove that I am not guilty of the crime I was coerced into pleading guilty too. I have incurred a large debt and because of the court cost, my family cannot send me any money, so yes, I am begging anyone who reads this, who feels it in their heart, and who can spare it to send me twenty dollars so that I can pay off my debt to the Department of Corrections and the courts and I can continue to not only fight for justice, on my part, but on the victims part. Lita Sullivan's killer IS STILL FREE and it can be proved. But I need money and support from those that care. On April 19th 1998, I was arrested for the murder of Lita McClinton Sullivan who was murdered on January 16th 1987, by a gunman, that an alleged eyewitness described as 6' Ruddy complexion, seedy looking and balding. As of this date I still have a full head of hair, and I'm not pretty, but I'm sure not seedy looking. The eyewitness viewed me in a line up in 1998 and did not pick me out as the killer. The flower man that sold the flowers, said I was not the one that bought the flowers and described two men that looked nothing like me. Now here's the legal stuff. On August the 24th 1998, my then attorney Bruce Harvey, filed a demand for trial and a waiver of arraignment. On September 2nd 1998, the state filed its notice of intent to seek the death penalty. According to law, the state, since their filing of their notice came after a waiver of arraignment and a demand for trial was filed. In order for the state notice to be valid, the state must re indict and must have the trial within the terms, which in this case ran from July to December. The state never Re indicted and therefore never invoked their notice. So my demand for trial was never tolled. But here is where the ineffectiveness of my attorneys and the deceit of the trial court judges and the district attorneys office begins. The state court and my attorneys "Four of them," allowed me to sit in jail from April 1998 to February 2003 and then allowed the state to use the death penalty threat, which had never been invoked, to bargain with me to accept a twenty year plea and the state would drop their notice of intent to seek the death penalty for murder. But the fact is, the state had never invoked their notice. So why did my four high profile lawyers, the court and the DA's office not protect my rights? Because they needed a conviction and they had no proof that I had committed the crime. Well you say, why would you plead guilty to a crime you didn't commit? My attorney told me that I would be found guilty and that I more than likely would receive the death penalty. There's a palm print that was taken off the flower box, it's not mine! I have told them who the killer is and I'm willing to bet they never checked his palm print against the flower box print. And I have a witness, that could verify that this man was hired by a woman to kill Lita Sullivan, and that I called off the hit before it took place. But without my witness getting immunity, she'll never testify. And! I wonder, if this alleged eye witness, which is an attorney also has seen this person named as the killer? The Assistant DA stated at Sullivan's trial, that the eye witness, after eight years now says that I'm the killer. An eyewitness may get a description somewhat wrong, but missing that someone was balding is not one of them. So, either Christenson is lying about seeing the killer, or he lied about me being the killer, and I know for a fact the killer was balding, so he must of seen the killer, so why now saying it was me? Because they needed me to be the killer to convict James Sullivan so they could close the case. At my plea hearing Emory McClinton, Lita's dad, stated that I killed his daughter. This almost made me jump up and say whoa here! I didn't kill your daughter, but I was afraid to go to trial, and I knew I was being SOLD OUT, Tom West, and now I'll prove it. "There's so much more." The arresting G.B.I. agent John Lang and Atlanta Detective Steve Balcum lied and said I was not put in handcuffs when I was arrested at my home. The courts twisted the laws and ignored due process and my constitutional rights, so I am complaining not only for myself and my injustice, but for also Lita Sullivan's And now according to the parole board guideline. I was suppose to do about six and a half years for parole. My parole month is eleven months before my release date. So I'll do nineteen years in prison for a crime I didn't commit or want or believe would be committed. If the court of appeals does not rule in my favor and let me go, then the courts will have to deny every legal ruling on the books and also deny that the Constitution of the United States exists. I have done everything that I know to do, to withdrawn my plea and go to trial, even if the state is allowed to seek the death penalty, I'd fight all the way this time! There are some things I can't put in this bio concerning other proof that the killer is actually the killer, but, my attorney Robert Citronberg, knows about it, and he's done NOTHING to help me! As a matter of fact, he told me that Dalton Vs State, was not relevant to my case this case and mine, on the legal issues are twins. I don't know where I would want to live, maybe Texas or North Carolina, but for sure, I'd never live in Georgia. I've met too many men that's in prison, that should not be! I'm not talking about constitutional violations. I'm talking about not guilty of anything according to law. It's just here in Georgia, its about a conviction. Okay the above is partly why I'm in prison, now I'll move on to more about myself and what I'd like to happen when I get out. I love animals, especially horses. The Gypsy is my favorite and I want a Jack Russell dog. I like birds also. The blue bird and hummingbird are tops. I write poems and stories of all sorts. If I get a few replies, I'll update my profile and give some samples. I love to write stories. I can write and never be bored. Now, I do a lot of sewing and I do a lot!! It relaxes me and keeps my mind off of the situation. I don't do drugs or drink and smoking will soon be a thing of the past. I'm told that I sing really well, I have a bass voice and at times I can hit some high notes. I'm an ole car buff, the 63 1/2 Ford Galaxie 500 is the only car for me. I've done heating and A/C installation and I've drove truck all over the 48 states, because I have no home to go to. I'll probably drive truck for a year or two, then build or buy something to live in. I like the country living. Cows, chickens, and of course horses. I'm very healthy and I don't look my age, I've been told. So if you are inclined and hopefully curious drop me a line or two. Lets get to be friends and maybe more later. If you can help me with my indigent situation, I'd be thankful. If for only friendship I'd be grateful. I'm sending what needs to be sent, in case your heart feels the need to send money, because these thieves that work for the D.O.C. steal our money, so they've fixed it to where it's not sent directly to us. To be honest, I owe over $600,000 and if proof is needed I'll be glad to send it. I'm sure there are a lot of questions out there that have need of answers. I hope Emory McClinton will ask questions to Paul Howard and make a statement to the press. The DA's office has lied to him and if the eyewitness, Robert Christenson is now saying that I'm the killer, then he is lying!! If I were the killer I would not be trying to withdraw my guilty plea, and take a chance on being railroaded and given more time. That makes sense doesn't it? Well that is it for now. I'd like to ask please, when you write, please send me a close up of your face and then a full length, and be up front with me concerning your dreams and past. Friendship is first in any relationship and lies have no place at all. Since I'm indigent, I can only write three people per week, but I will answer all letters that have photos included. Ladies I know how to treat a woman and after 12 years I've got a lot of kindness stored up.
